    Just found something... look at pg. 4 of this newsletter. It describes the general case. I will try to look for the actual case decision online. Info in the caption to the illustration.

    The case title citation given is
    National Cloak and Suit Company v. Joseph Sonken and Mose Silverman, 1920.     Well I found it, in case anyone is following this.

    It was a suit brought by National cloak against Kaufman. They claimed certain styles in this particular 1910, catalog, named by page and style #, were taken and used in the defendants catalog.
    The suit was dismissed because even though NC&S may have had a copyright on the designs, because of long and complicated reasons you may for read yourselves on page 186 - https://books.google.com/books?id=h...-6BJgQ6AF6BAgKEAI#v=onepage&q=page 22&f=false - the copyrights did not stop anyone from copying them and recreating them.

    Great that you found it! A different case from the one I cited, which was from about 1920-1925.

    So...... this National Cloak and Suit Company ..... brought a ' suit '.....that's ' cloaked ' in mystery !!!

    I know ........low hanging fruit..........but words are funny !!
