    Jeff Drum suggested it would be fair from me to pass on the shipping costs as he thinks I can salvage something from the wreck, and the seller has a total loss:sorry:

    After the seller's answer, :eek: I certainly don't have the intention to be fair (blonde?:hilarious:)

    You are entitled to a full refund including shipping costs. The seller is responsible for making sure the item is delivered without damage - all the way to your door.

    HOWEVER - in this case - the transaction was part of the GSP - so the seller is only responsible for getting the item to the GSP center in the US. If the item had been damaged before it got to the GSP - the GSP would have rejected it. Once the GSP accepts it - the seller is off the hook, and the GSP becomes responsible for the item (packed poorly or not).

    You are doing the right thing by opening a refund case with Ebay - after you tell them what happened and provide pictures - they will(should) have the GSP refund you fully - including shipping - but the seller will get to keep their money - even though they should have done the right thing and refunded you directly given their poor excuse for packing.

    GSP is a win win for the seller.......which lets them off the hook......but I don't care whom you have to gut like a fish to get a full refund...... U Go Girl !!!!!:):):)

    Here’s a translation.

    So sorry to see that. (I just said that to sound nice)
    It looks to me like the postal service is to blame here. (Even though my packing job was lame)
    I can see that the box was crushed and it was differently not like that when I left it at the post office. (Because it hadn’t been shipped yet)
    By the way the box looks I don't think cardboard between them would have made any difference at all. (Because I didn’t use enough bubble wrap and a strong enough box)
    I have never had an issue like this ever. (Therefore it’s someone else’s fault, Please feel bad for me)
    I'm not sure what you want me to do. (Please don’t ask for a refund)
    I think you should contact your postal service about weather or not it was insured
    (Crap, I didn’t insure it)

    Guess what....
    I requested return the item arrived damaged through Ebay help center, and without further answer from the seller, I opened the case by phone.
    The Ebay.fr person was horrified by my pictures and assumed Ebay.com will take my point:D

    And... SURPRISE!
    Seller opened a case too :bucktooth::hilarious:

    The picture of the box clearly shows that it was damaged by the postal service. The Buyer is being unreasonable. I don t believe I should be held responsible for items that are shipped out the country by a 3rd party. Buyer claims it was because of my packaging but clearly the box was crushed at some point. These fans are fragile and it is possible that the buyer damaged it further after handling.

    Sure, I damaged such a precious piece:mad:

    What did she expect using eBay's shipping system???? :rolleyes::rolleyes::rolleyes:

    I have been following your saga & thought about it yesterday wondering if you had heard back from anyone. I know you will keep fighting on this one, but I do believe ultimately you will get a refund from someone. If the first person turns you down keep going up the food chain until you get someone to listen to you. :p:p

    Kyra, I'm so glad you've got ebay.fr on your side. Any sane person can see you've got a legitimate case and the seller hopes attack is the best defense.

    The saving grace from my saga is the neutral has at least disappeared from the front page. You have to click the "view all feedback" option to read the comment. However then you see the ones immediately above & below the comment are absolutely glowing. :smuggrin::smuggrin::smuggrin:

    She had to respond in some way or another or eBay automatically closes the case in I believe 3 to 4 days. However, the way she chose to respond is beyond ridiculous.

    Plain & simple, it is the buyers job to find the item, buy the item & pay for it promptly; it is the seller's job to make sure the item can be found by listing it correctly & then package the item so that it gets to the buyer in the same condition in which it was shown in the listing.

    So frankly she did not do her job, consequently she should be held responsible.

    End of story.

    This is the best thing she could have said, that should work in your favor.

    Fact: She’s acknowledging and agreeing that the items were fragile.

    Fact: There are standards for packing such items that clearly wasn't done by her, knowing they were fragile.

    Fact: She only offer assumptions on your actions and of the carrier in an attempt to repudiate her responsibilities.

    It is wrong of her to make additional assumptions that this package would be individually hand carried from point to point. Completely feckless on her best day.

    I had a message from Ebay, the case has been closed... because I formerly signaled an issue to Paypal:facepalm::sorry:

    I did this first, upon receiving the damaged fans...

    I wasn't aware the item was eligible to Ebay buyer's protection before you told me to open a "return the damaged item" case:banghead:

    Sooo, unable to send the dispute via the Paypal internet site, I had to phone to them to switch my case into dispute:singing:

    They told me the transaction funds are blocked, and they will wait for the seller's answer up to 10 days as this is mandatory (even if she will certainly repeat her fallacious argue:p).

    All costs will be refunded to me, for those of sending back the parcel, I'll have to open another case:banghead:

    So, lesson learned, first you should act with Ebay buyer's protection:smuggrin:

    Lord, that is horrible.... every time I have received a broken item it was because of improper packing, except a few times with UPS....how they could destroy a 12 x 36 x 24 box with Styrofoam is beyond me, but they destroyed a saw table and had the audacity to leave it on the porch and run with no signature. Good thing to know about Ebay Buyer protection... I have never used it , always PayPal and paypal takes forever some times............
