Loaning Furniture to Designers

    The last time I did this I had some artwork go missing from a showhouse and end up in the designer's home. Found out through a friend who went to a party there.

    I have an opportunity now to loan some furniture pieces to a more reputable and important designer for a showhouse at a design festival where they will be for sale.

    Does anyone here do this and do you have a loan agreement form or advice on putting one together?

    Of course, it is very flattering to have one's artwork "borrowed" by a designer.

    I haven't come across this, but I have given antiques in consignment to other dealers in the very distant past. I always made sure I had all the legal forms, signed and witnessed, and also checked insurance coverage. You never know.

    Hi,
    I used to lend movie companies furniture and glassware. The last few times the people looking for movie props ONLY bought since so much was stolen or broken by people on the set. In the lending always had so many forms it was stacks of paperwork. It was better that they started buying the stuff. The most famous stuff I sold was the Fiestaware in "A Christmas Story" and the toy Zeppelin that the brother got for Christmas.

    Might want to consult an attorney to draw up a contract for you with clear terms and conditions that will clear up any future disputes. Can include provisions that provide for situations where items are not returned or are not returned in satisfactory condition.

    I have an agreement, somewhere, that artists use when they consign their work to a gallery. It also contains a clause that if the gallery declares bankruptcy, the artwork is not considered part of the galleries assets. That clause, also requires a form be filed within the city or town that the gallery is located in.

    Some of these show houses hire contractors to do some rennovating. If there is a problem with payment, a contractor can put of lien on the property and/or it's contents, so it would be beneficial to have that clause for this reason as well.

    I don't have experience with this situation, but did loan some items to a museum for exhibition once. The contracts specified dates for pick-up and return, a reputable art-shipper to pick up and pack the items; insurance to be provided by the museum (they accepted my valuations) including coverage from the minute the items were picked up to the minute they arrived back; ownership to remain with me during the loan; multiple photos and description of each item; very comprehensive contracts, and that is certainly what I would suggest.

    I searched several places and couldn't put my hands on the contract I mentioned above. I had one from the DeCordova Museum when they had a piece of mine on loan. We had a flood a while ago and things are still not organized. If it turns up, I will still post it for you.
