It would have been lovely but it wasn't to be, the damage is bad. The seller said the box was locked and the key was missing. From what I can see the seller has tried to open the lock by trying to push the key round part of the lock through the box and broken the wood behind the lock on the front :(

I opened a dispute with ebay after the seller refused to take a return saying I had done the damage, I managed to speak with customer support and explained they had sent it out like that, they told me to message the seller and say if they didn't take the return after 5 days ebay would step in and after another 5 days ebay would give me the money and I could keep the box as well. The seller contacted ebay after my contact and raised a dispute so ebay found in my favour and gave me a refund. This all happened in one day (today) I'm yet to hear from the seller but my thoughts are, maybe ebay paid the money out of their pocket? the seller had 800+ 100% feedback and I have 500+ 100% feedback, I wonder if ebay didn't want to upset either of us because I haven't had any messages from the seller since then.

Sounds more like it was misrepresented / not as described rather than shipping damage. Still on the seller to cover shipping

Sorry this happened, what a pain.

Unlikely Ebay paid (refunded) you out of Ebay funds. Once they found in your favor, the money was automatically deducted from the seller's account.

That's a tough one. You may still get a return label from the seller.

Shame there was damage. It's a beautiful box.

When I have returned items in the UK , usually the seller sends you a return postage label and once it is received by them then eBay refunds. I’m surprised they refunded without asking you to return the item.

"I’m surprised they refunded without asking you to return the item." Yeah thats why I posted the question, I'm shocked I didn't get a return label from the seller or even a message from either ebay or the seller?
I re-packaged it as soon as I saw the damage and I'll leave it like that for 2 weeks. I did have the same thing with a Amazon seller who said there was a program pre-loaded on to a laptop but it wasn't and Amazon gave us a refund and told us to keep the laptop as well. I did think that was a bit harsh on the Amazon seller but this ebay seller knew the box had bad damage, so if they end up loosing out they deserve it.

Sometimes if the seller doesn’t have a lot of $ in the item and the return postage is costly it’s cheaper for the to just let the seller keep the item. I’ve had sellers tell me to keep items and I’ve told buyers to keep items in some cases. Cheaper to take the loss then pay to get a damaged item back. However I believe that the eBay policy gives the seller 5-10 days or so to get the buyer a return label. After that period is up then it’s “legally” yours.

Thanks for the advice, I'll be starting restoration work in 9 days :) It was over £400 hammer price so I would have thought economically the seller would like to see it returned.

Not if they only had 10 quid in it! Church sale scores happen, even now.

I would love to find something like that in a cheap sale but I think most of the UK are clued up on Boulle, in fact a lot of people in the UK know about most antiques, I blame Antiques roadshow :(

Thinking about it, my winning bid was £398+PP and I thought once restored it would be worth 3-4x that and that's not knowing who made/sold it, it has a bramah lock, normally a sign it was produced by the finest maker and sold for twice the price of one without. It's the only English Boulle box I've ever seen with a bramah lock so if I do get to keep it I'll be excited to open it and see who made it.

I think ebay might have just paid the money to save 2 long term customers. What really gets me is why someone with over 800 100% feedback would risk me giving them thumping bad feedback? There was no damage to the box it came in, I defiantly didn't do the damage, they must have seen the damage if not done it themselves trying to open a locked box. They didn't know what it was, it was listed in boxes and tins (not in antique boxes) as "Antique 19th C Brass Inlaid Marquetry Stationary Box caddy" locked with no key. The start price was £80, fortunately for them it was spotted by more than one person who knew how rare English Boulle is. Lets hope in 8 days I re-post on this thread saying it's mine :). The pity is I will have slide a multitool between the lid and the body where the keep of the lock is and cut through the keep, I was going to try picking the lock but with a bramah lock you need to push a heavy spring in before being able to move the sliders, the box front just won't take that force and I'm afraid the wood will just break off behind the overlay. I do have a bag of antique brass keeps so I might just have a replacement.

Other buyers knew it was Something, just not what, and didn't know what the lock was. Heck, neither do I. Tortoishell here is illegal to sell no matter how old the piece is, with a few narrow exceptions, so some people may never see it. Only a real dealer would know what boulle work looks like.
